Judge rules no porn in the Kay

eXXXoticaU.S. District Judge Sidney Fitzwater has ruled in favor of the city of Dallas and against the love and sex expo eXXXotica, declaring that the city was neutral in its decision to ban the expo from renting the Kay Bailey Hutchison Convention Center.

Attorney General Ken Paxton filed a brief siding with the city and Dallas Citizen’s Council.

“We are pleased with this ruling,” Paxton said. “I was happy to join the Dallas Citizens Council in this effort that allows the city of Dallas to be a place where businesses can continue to flourish.”

Huh? What?

He didn’t explain how banning a business from the city resulting in lower sales tax revenue, fewer visitors to the city and no rent for the Kay makes Dallas a place where business is flourishing.

Fitzwater ruled that the city had a right to refuse eXXXotica, “because a city-owned convention center is not a public forum.”

Does that mean Dallas is not a public city, either? Or does the city, meaning the public that lives here, not own the convention center? How does a city own something that isn’t public?
