Virginia Lawmaker: Feds Can’t Stop Us From Banning Gays From National Guard

Back in December, wingnut Virginia legislator Bob Marshall announced a bill to ban homosexuals from serving in that state’s National Guard. Today we get the text of that bill, which lists numerous examples of gays being booted from the military after declaring that the federal government has no right to tell Virginia who can serve in its National Guard.

A state may have different eligibility standards for membership in a State’s National Guard than for membership in the Armed Forces of the United States (e.g., education, driving record, drug use, criminal record, age, and other criteria). Such eligibility standards are not within the power of the U.S. Congress because they are not matters of “discipline.” “training,” “arming” or “organizing” the Militia, or National Guard. At present, the Virginia National Guard and the U. S. Army have different eligibility admission criteria than the Armed Forces of the United States, and the Commonwealth of Virginia has authority to determine whether or not an active, open and practicing homosexual should serve in the Virginia National Guard. There is no constitutional right to serve in the National Guard.

Arne Duncan, the education secretary, is having his minions look into the little matter of California's Tehachapi Unified School District, his office confirms. The move comes after Wendy Walsh, the mother of 13-year-old Seth who hung himself from a tree and left his mother a suicide note fingering his school for ignoring his torment, teamed up with the ACLU to call bullshit on the district's failure to intervene. Seth told his mother in his note that he wanted her to "make the school feel like shit for bringing you this sorrow."

Eric Holder: The Feds Will Still Prosecute Pot Crimes In CA If Prop 19 Passes

Attorney General Eric Holder says that even if California voters legalize marijuana via Proposition 19, the federal government will continue to prosecute pot cases there.

On Friday, US Attorney General Eric Holder announced that the Obama administration would “vigorously enforce” federal drug laws against people who sell, distribute or grow marijuana for recreational use. Holder sent a letter to nine former chiefs of the US Drug Enforcement Administration, saying in part: “Let me state clearly that the Department of Justice strongly opposes Proposition 19. If passed, this legislation will greatly complicate federal drug enforcement efforts to the detriment of our citizens.” Los Angeles County Sheriff Lee Baca hosted a news conference Friday morning to draw attention to the letter. Prop. 19 would allow Californians 21 and older to grow up to 25 square feet of cannabis plants, and to possess up to an ounce of marijuana. It would also empower cities and counties to regulate marijuana cultivation and sales. Several municipalities are poised to do so if the law passes, with initiatives concerning taxation and regulation on the same ballot as Prop. 19.

The Tenthers are surely salivating at the prospect of this potential clash between state and federal laws. However many have pointed out that the feds simply don’t have the manpower to launch any significant campaign against home-grown pot in California.
