9th Circuit Keeps Stay On Prop 8 Ruling: No Marriages Just Yet

The Ninth Circuit Court of Appeals has granted ProtectMarriage.com's emergency request for a stay in Judge Vaughn Walker's Prop 8 ruling, which means the possibility of same-sex marriage resuming on Wednesday, when Walker ordered a temporary stay lifted, is dead. The Court did, however, place the case on its "expedited" list, and will (theoretically) more quickly decide whether to rule the defendant-intervenors have proper standing to appeal.

California attorney general Jerry Brown has filed papers with the 9th U.S. Circuit Court of Appeals saying same-sex marriages in the state should begin again as quickly as possible.

Newt’s second wife, Marianne, talks about his three marriages, two divorces and annulment

What great timing. Last week, thrice married Newt Gingrich was one of the first right-wingers to trash the Prop. 8 decision. It was the height of hypocrisy.

Then, this week, Esquire printed a profile of Newt Gingrich, complete with some revelations from his second wife, Marianne. She talked about their divorce for the first time:

She kind of guessed it, of course. Women usually do. But did she know the woman was in her apartment, eating off her plates, sleeping in her bed?

She called a minister they both trusted. He came over to the house the next day and worked with them the whole weekend, but Gingrich just kept saying she was a Jaguar and all he wanted was a Chevrolet. ” ‘I can’t handle a Jaguar right now.’ He said that many times. ‘All I want is a Chevrolet.’ “

He asked her to just tolerate the affair, an offer she refused.

He’d just returned from Erie, Pennsylvania, where he’d given a speech full of high sentiments about compassion and family values.

The next night, they sat talking out on their back patio in Georgia. She said, “How do you give that speech and do what you’re doing?”

“It doesn’t matter what I do,” he answered. “People need to hear what I have to say. There’s no one else who can say what I can say. It doesn’t matter what I live.”

Newt’s a Catholic now. He had both previous marriages annulled in order to marry the woman, Calista (a.k.a. “The Chevrolet”) with whom he was having the affair when married to Marianne.

So, I particularly enjoyed Marianne’s comments on Newt’s Catholicism:

When asked about his conversion, Marianne laughs.

Why is that funny?

“It has no meaning.”

It has no meaning?

“It’s hysterical. I got a notice that they wanted to nullify my marriage. They’re making jokes about it on local radio. The minute he got married, divorced, married, divorced — what does the Catholic Church say about this?”

It doesn’t matter what Newt does or how he lives his life. It’s what he says. That will make a great slogan for his presidential campaign.

Schwarzenegger, California AG Jerry Brown File Motions Urging Judge Walker to Allow Same-Sex Marriages to Resume

UPDATE: Governor Schwarzenegger wants same-sex marriages to resume immediately!

"The Republican governor filed his brief with U.S. District Court Judge Vaughn R. Walker before a Friday deadline to submit arguments on whether to continue a stay of Walker's decision against Proposition 8.
'The Administration believes the public interest is best served by permitting the Court's judgment to go into effect, thereby restoring the right of same-sex couples to marry in California,' wrote Kenneth C. Mennemeier, an attorney representing Schwarzenegger, in the brief. 'Doing so is consistent with California's long history of treating all people and their relationships with equal dignity and respect.'"

California Attorney General Jerry Brown has filed a motion opposing a stay of Judge Walker's decision striking down Proposition 8:

Brown "Brown told U.S. District Chief Judge Vaughn R. Walker that his historic ruling that overturned Proposition 8 probably will be upheld by higher courts. He said his office last year opposed a pretrial request to block Proposition 8 only because the legal and factual issues had not then been explored.

'That has now occurred,' Brown's office said. 'And while there is still the potential for limited administrative burdens should future marriages of same-sex couples be later declared invalid, these potential burdens are outweighed by this court’s conclusion, based on the overwhelming evidence, that Proposition 8 is unconstitutional.'

Gov. Arnold Schwarzenegger is also expected to oppose a hold on the ruling."

Written arguments were due today regarding the stay. Walker has said he'll decide after reviewing them.

In an extraordinary court filing, Gov. Arnold Schwarzenegger asked Friday that gay marriages be allowed to resume immediately in California after a federal ruling that the state’s voter-approved ban on gay marriage is unconstitutional. The Republican governor filed his brief with U.S. District Court Judge Vaughn R. Walker before a Friday deadline to submit arguments on whether to continue a stay of Walker’s decision against Proposition 8. “The Administration believes the public interest is best served by permitting the Court’s judgment to go into effect, thereby restoring the right of same-sex couples to marry in California,” wrote Kenneth C.
