Remembering John Lawrence, the man behind Lawrence v. Texas

Metro Weekly reports that one-time Houstonian John Geddes Lawrence, the “Lawrence” in Lawrence v. Texas, passed away last month at the age of 68:

“In the facts underlying the Supreme Court case, Lawrence v. Texas, Lawrence and Tyron Garner were arrested under Texas’s Homosexual Conduct Law after police entered Lawrence’s home on Sept. 17, 1998, and saw them “engaging in a sexual act.” The couple challenged the law as unconstitutional”

I was 22 and living in Dallas in 2003 when the Supreme Court issued its opinion in Lawrence declaring Texas’ law against “homosexual conduct” unconstitutional. A group of over 100 people gathered in the parking lot of the Resource Center of Dallas as Dennis Coleman, then with Lambda Legal, read excerpts of the decision. I remember the exuberant electricity in the air, the crowd bubbling with joy and the relief of centuries of official oppression finally coming to an end. Similar get-togethers took place across the state, as an entire community breathing a collective sigh of relief.

That relief has turn to frustration over the years. Although the Supreme Court decision rendered Penal Code Section 21.06 unconstitutional, the law remains on the books, and efforts to remove it have met with significant resistance. During a hearing this spring on finally removing the unconstitutional law, Rep. Jose Aliseda, R – Pleasanton, lamented that repeal of the law would entail removing portions of the Health Code requiring that HIV education efforts include information that “homosexual conduct is not an acceptable lifestyle and is a criminal offense under Section 21.06, Penal Code.”

Before Lawrence several attempts were made to remove the law against “homosexual conduct.” The Texas legislature voted to remove it from the penal code as part of a complete rewrite of the code in 1971, but the measure was vetoed by Gov. Preston Smith. In 1973 the Legislature again undertook a rewrite of the code, keeping “homosexual conduct” a crime but making it a class C misdemeanor. In 1981 a U.S. District Court ruled in Baker v. Wade that the law was unconstitutional, but as that case was winding its way through an unusually torturous appeals process the Supreme Court ruled in Bowers v. Hardwick that a similar law in Georgia was constitutional, making the questions in Baker moot. Similarly, in the 90′s there was hope that Texas v. Morales might finally prevail in defeating the “homosexual conduct” prohibition, but the Texas Supreme Court decided that since, in their opinion, the law was rarely enforced, there was no reason for them to rule in the matter.

Lawrence’s legacy lives on in a scholarship named after him and Garner administered by the Houston GLBT Community Center. The scholarship “recognizes outstanding leadership shown by gay, lesbian, bisexual, and transgender Texas high school seniors and college
students by contributing to the cost of their continuing education. Selection is based upon character and need.” Tim Brookover, president of the community center, expressed sorrow at Lawrence’s passing “John was a hero, the community owes a great debt of gratitude to John and Tyrone for taking the case all the way to the Supreme Court,” said Brookover. “They could have easily allowed it to slip away, but they decided to stay and fight and that makes them heroes and role models.”

The application deadline for the John Lawrence/Tyrone Gardner Scholarship is March 2, 2012.

Victory in HCC trans discrimination case (sort of)

As previously reported by our friends over at the Dallas Voice, in September a Houston Community College teacher, Donny Leveston, led an in-class conversation about “Taboo: Incest and Homoeroticism” in which transgender people were referred to as “freaks” and “weirdos.” In an official response from the HCC Office of Institutional Equality the school admitted that the instructor acted insensitively and failed to show proper concern for a transgender student in the class who later withdrew from the school over the incident. Despite this, HCC found that Leveston did not violate the school’s policy against Discrimination and Harassment and will not be disciplined or required to attend training on transgender issues.

Make a Pit Stop in Oak Cliff

As you might have read, queer filmmaker Yen Tan is hard at work on his next project Pit Stop. After the success of his film Ciao, Tan focuses again on the community with his latest film about two men who find romance in each other in a small Texas town. The film is still in the works but he gives a sort of preview tonight with staged readings from the script as well as showing clips from Ciao. He teams with OutTakes Dallas for tonight’s movie launch event in Oak Cliff. The night will also feature a conversation with Tan and producer Eric Steele.

This is an official Dallas Pride 2011 event.

Perfect match

Bob Nunn and Tom Harrover have been a couple for 4 decades. But it wasn’t until a near tragedy that they realized they were truly meant for each other

Bob Nunn agrees with the adage that the longer a couple lives together, the more they begin to look alike. Nunn and his partner Tom Harrover might not look that similar on the outside, but they match in a way that few couples do.

Let’s start with some history.

The two have that classic meet-cute that began on the wrong note. As Nunn tells it, Harrover was the dullest person he’d ever met —the two just didn’t like each other. Then, following a spontaneous invitation to a midnight movie, they ended up hitting it off. That movie led to conversation and then dating.

Forty-two years later, they still watch movies — as Nunn puts it, “I couldn’t get rid of him.”

A job in Houston took Nunn away from Harrover for three months, but old-fashioned letter writing kept the newbie relationship afloat.

“Tom had been writing me letters. He’s a very good writer,” Bob boasts. “He basically proposed to me by letter.”

They committed to each other, moving in and pursuing their careers: Harrover in architecture and Nunn teaching art. For 37 years, they lived in “a fabulous house” in Hollywood Heights. Life was good.

Then their life took a sharp turn.

“When we got together, Tom knew I had a kidney disease,” Nunn says. “Nothing was really a problem until about 30 years after we met — my kidneys began to fail and I had to start dialysis.”

Nunn registered with Baylor for the national organ donor list, but the experience was frustrating:  They received little response or encouragement from the hospital.

“Bob was on a downhill slide and the frustration with Baylor seemed like they were stonewalling us,” Harrover says. “We talked about going to Asia even. It felt like they didn’t want to deal with a senior-age gay couple.”

Then Harrover suggested something novel: He could donate his kidney to the organ list, with the idea that Nunn could get a healthy one.  Sort of a kidney exchange.

In desperation, they went back to their physician, who enrolled them in St. Paul Hospital’s then-new program for kidney transplant. The experience was a complete turnaround. Nunn was tested and processed immediately while Harrover prepped for his organ donation to an anonymous recipient.

Kidney transplants require a seven-point match system; a minimum of three matches is necessary for the recipient to be able to accept the organ into the body.

The tests revealed that Harrover’s kidney matched Nunn’s on all seven points.

“We assumed I would donate mine for use elsewhere,” Harrover says. “It never occurred to me that we’d be a match. The odds for that are off the charts.”

“See what happens when you live together for so long?” he chuckles.

Just six months after entering St. Paul’s program in 2007, they were on the operating table. They were the first direct living donor pair in the program. “It was all fairly miraculous,” Nunn understates.

Four years later, both men are doing well. Although officially retired, they both continue to work: Harrover does the occasional contract job while Nunn is currently on commission for an art project at the new convention center hotel. Outside of any official work, each interjects their quips about home, life be it cooking together or working on the lawn.

The obvious question for them might be “What’s the secret?” But they don’t see it just that way. Their relationship boils down to the obvious virtues of trust, respect and compromise.

“Selfishness doesn’t rear its ugly head in this relationship,” Harrover says. “You just have to be willing to accommodate, support and encourage what the other is interested in.”

Nunn agrees. “I would not be doing what I’m doing without his support.”

Nunn says if there is a secret, it’s akin to the dynamic on a playground: Like each other and share. If you don’t share your whole life, there isn’t a relationship, he says. At this point, Harrover says it would be impossible to separate. On paper, they are so intertwined with their house and financials, he jokes they are “Siamese twins.”

They’ve witnessed a lot in their decades together, including something they never expected to come to pass in their lifetimes: Same-sex marriage. Coming from a time when just being gay conflicted with moral codes set by their jobs, they wonder over the progress made in recent years. (They were officially married in Boston in October 2009.)

“I’m confident that it will happen for everyone,” Harrover says. “I’m sorry that it’s moving at a glacial pace, but it has that same inevitability as a glacier. We’ll get there.”

But nothing compares to the bond Harrover and Nunn already have, a shared intimacy few couples could imagine. Same-sex marriage was merely unlikely; what they have experienced is miraculous.

GOP Official: Gay pirates are invading Tampa!

Lions and tigers and GAY PIRATES!… Oh my!

Eugene Delgaudio, a Republican official in Virginia’s Loudon County, best known for claiming that gay TSA agents were getting their jollies patting down male passengers’ junk, is sending out a letter to his constituents claiming that radical homosexual pirates have invaded Tampa Bay, Florida, and are roaming the streets. My bags are packed and I’m hopping the first flight to Tampa with my copy of “How To Talk Like A Pirate” safely tucked under my arm. What fun! I am particularly looking forward to some of the novel uses one might make of a parrot during a gay encounter with a pirate.
January 29th is the 106th annual Gasparilla Pirate Fest in Tampa Bay, Florida. By all accounts it is quite some event, opening with a real live pirate ship docking at port, and literally hundreds of people in pirate costumes “invade” the city in groups called “krewes” The event is a full two weeks of seemingly family oriented events

When I think of family-oriented events, real live pirates are pretty much the first things that pop into my mind. Nothing brings a family together like kidnapping, robbery on the high seas, plank-walking, rum-drinking, some fitful sodomy, and, of course, the occasional lash.

It’s official: For GOP hopefuls, making life harder for LGBTs will remain a primary goal

Fischer-PawlentyHaley Barbour loves his gay marriage ban. Mike Huckabee loves most all gay marriage bans. And now a third potential 2012 presidential candidate on the GOP side, former Minnesota Gov. Tim Pawlenty, tells the American Family Association’s Bryan Fischer that he’s itching to keep/reinstate a ban on open military service for gay soldiers:

Pawlenty: Bryan (Fischer), I have been a public and repeat supporter of maintaining Don’t Ask, Don’t Tell. There’s a lot of reasons for that, but if you look at how the combat commanders and the combat units feel about it, the results of those kinds of surveys were different than the ones that were mostly reported in the newspaper and that is something I think we need to pay attention to. But I have been a public supporter of maintaining Don’t Ask, Don’t Tell and I would support reinstating it as well.

Ya know, I knew when I woke up this morning that I felt my sense of being able to breathe easily in my country subside just a bit. I thought I was coming down with something. Should’ve known it was just GOP primary season heating up.

Though we do should all give Mr. Pawlenty a compliment in terms of where he chose to make this statement. Because if one is going to support something as out-of-touch with the public as the reinstatement of Don’t Ask Don’t Tell, then it certainly makes sense to say it to a man who’s contributed things like this to the discourse:

“homosexuals in the military gave us…six million dead Jews

“homosexuals should be disqualified from public office

Called on Christian conservatives to breed gays and progressives out of existence,

Called gay sex a “form of domestic terrorism

Said only gays were savage enough for Hitler

Compared gays to heroin abusers

Directly compared laws against gay soldiers to those that apply to bank robbers

Invoked a Biblical story about stabbing “sexually immoral” people with spears, saying we need this kind of action in modern day

Spoke out against gays serving as public school teachers

Questioned why Medals of Honor are given to people who save lives (rather than take lives)

Said that open service will “assign the United States to the scrap heap of history”

Blamed gay activists for dead gay kids, saying that: “If we want to see fewer students commit suicide, we want fewer homosexual students.”

Virginia official: the next TSA agent patting you down could be a horny homo

Blender Verdon Coleman passed this gem of elected official homophobia on to us for your infotainment. Eugene Delgaudio an elected official on the Loudoun County Board of Supervisors in Virginia and he is thinking really hard about the TSA pat down enhancements and sexual arousal.

A widely distributed e-mail written by Delgaudio for the Public Advocate about TSA, claims the pat downs are part of a “Homosexual Agenda.” And he criticizes TSA’s non-discrimination hiring policy.

“It’s the federal employee’s version of the Gay Bill of Special Rights… That means the next TSA official that gives you an ‘enhanced pat down’ could be a practicing homosexual secretly getting pleasure from your submission,” Delgaudio wrote.

…Part of his official role on the Board of Supervisors includes representing the county in the Dulles Area Transportation Association.

In his other role as President of the wingnut Public Advocate of the United States organization, I assume he and The Peter are comparing notes about this topic.  Delgaudio receives bonus points for being the subject of a post by barista Alvin McEwen earlier this year, “‘Men hand-in-hand skipping down to adoption centers to ‘pick out’ a little boy for themselves’.”

After such an inspiring victory on Election Day, I want to keep the celebration going as much as you do.

But a very real threat looms.

And they are coming back in early November for a “Lame Duck” session to pass as much garbage as possible before the newly-elected congressmen and senators are sworn in…

Even worse, with Election Night behind them, the fence-sitters you and I have kept in line for so long know that they won’t have to face us again for 2, 4, and some even 6 years.

Because of that, they are now bolder than ever … while you and I are at our weakest having given our all last month.

And of course the Homosexual Lobby, ever eager to pounce upon our weakness, is preparing a massive onslaught devised to ram through every aspect of their radical agenda, from…

*** The Gay Bill of Special Rights will force schools and churches to hire and prevent them from firing open homosexuals.  Men dressed as women will have the “right” to share bathrooms with young girls and those who disagree will face lawsuits, even prosecution; to,

*** The repeal of the Defense of Marriage Act will eliminate the legal protection we’ve established for those states that reject Homosexual “marriages” by codifying traditional marriage into law; to,

*** The Homosexual Classrooms Act will create pro-homosexual indoctrination classes designed to eradicate traditional values in the next generation of American students; to,

*** The repeal of Don’t Ask, Don’t Tell forcing      our soldiers to share foxholes, bunks and even showers with open homosexuals.  The U.S. military, once representative of the best in America will degrade into a social experiment of homosexual activism; to,

*** The Homosexual Adoption Bill will force private religious adoption agencies to allow homosexual “couples” to adopt young boys and girls into their homosexual “family.”

The Homosexual Lobby knows that it is harder to repeal a bill than to keep it from passing.

So even though they’re facing losses in the new Congress, the Radical Homosexuals know if they can ram through the Homosexual Agenda now, they will have won.

I have to be honest with you, my friend.

Every gain we made on Election Night will mean nothing if they succeed in this “Lame Duck” scheme.

You see, they only have to win once.

You and I, on the other hand, must keep defeating their radical schemes over and over again.

The fact is, this so-called “Lame Duck” session of Congress could be the biggest disaster the family has seen in years.

And I’m afraid to admit it but… if you and I are unable to defeat the Homosexual Lobby’s schemes in the next 4-5 weeks, the fight for the family will be set back decades.

And that is why the celebration must end.

You and I cannot be lured into a false sense of security.

We must be ready for this fight.

Harry Reid’s own spokesman even let it slip that the Homosexual Lobby has plans to bring Don’t Ask, Don’t Tell back up for a vote in the “Lame Duck” Congress.

Can you imagine everything else the pro-homosexual politicians have up their sleeve?

They think you and I have already declared “Mission Accomplished” and that we aren’t prepared.

They think they will roll right over us.

And as much as my faith tells me not to worry, I’m afraid they might be right.

The Homosexual Lobby has hatched scheme after scheme in their endless attempt to ram through their agenda.

It’s taken every last bit of Public Advocate’s resources to fend off their advances.

That’s why I was so thankful for the last minute support I received last month right before the election.

Without that help, Public Advocate would have been helpless in the run up to that historic election.

But I have to confess.  I got so carried away exposing pro-homosexual politicians and defending advocates for the family that I spent more than I should have.

And the coming “Lame Duck” session of Congress may very well be the straw that broke the camel’s back.

But we do have one advantage on our side.

Pro-family Americans held the Homosexual Lobby’s allies in Congress accountable on election night.  They’d be lying to you if they said they didn’t take notice.

You and I need to make it clear that November 2nd, 2010 will happen again and again until they stand up for the Family.

That’s why I need your help again.

I’ve prepared a petition for you to sign stating your opposition to the Homosexual Agenda and letting your congressman and senators know we’re still watching.

But in addition to your signed petition, I’m really hoping you will be able to send as generous a contribution as you can.

In fact I’m counting on it.

Fighting the Homosexual Lobby is not cheap.

And with their aggressive attacks and dirty tactics it can become downright expensive.
