WATCH: Keller teen petitions City Council to outlaw anti-gay discrimination in restaurants

After seeing an episode of the ABC reality show What Would You Do that was filmed at Norma’s Cafe in Farmers Branch last year, gay 16-year-old Isaiah Smith is trying to change a law in his own hometown, Keller.

In the ABC show, actors posed as a lesbian couple with children. The waitress acted shocked and said the children would be better off with a father. The point was to get a negative reaction from other customers.

According to a report by Dawn Tongish on KDAF last week, Smith has collected more than 400 signatures to encourage the Keller City Council to outlaw discrimination in restaurants in that city.

Austin, Dallas and Fort Worth are the only cities in Texas that prohibit discrimination based on sexual orientation in public accommodations.

In the report, Smith points out that gays and lesbians have no protection in Texas and, without a local ordinance, could be thrown out of a restaurant simply because of who they are.

Al Franken asks public for help passing Student Non-Discrimination Act

Sen. Al Franken, D – Minnesota, is asking the public for help passing S. 555, The Student Non-Discrimination Act, a bill that would prohibit discrimination against public school students on the basis of sexual orientation or gender identity. Under the provisions of S. 555 students who experienced discrimination because of their real or perceived sexual orientation or because of their association with LGBT people could bring a civil suit against the school officials or districts responsible for the discrimination. The bill currently has 34 co-sponsors (none from Texas) and its House companion (H.R. 998 by Rep. Jared Polis, D – Colorado) has 150 (with 7 Texan co-sponsors including Houston’s own Sheila Jackson Lee and Al Green) . Both bills have been referred to committee but neither has received a hearing, a crucial step towards becoming law.

In the video requesting the public call their Senators (after the break) Franken points out that federal law already provides protection for school children harassed because of race, color, sex, religion, disability, and national origin, but that no protection exists for sexual orientation or gender identity.

The inclusion of “association” in S. 555 is particularly well thought out. According to the Williams Institute nearly 1 in 5 same-sex couples in the United States is raising children, in Harris County 18% of same-sex couples are.  As these children enter school it’s important that they be able to receive an education without harassment or bullying due to who their parents are.

Franken is asking people to call the Senate switchboard at 202-224-3121 and encourage their Senator’s to support the bill.

Partners in life and in business, Darryl Allara and Ken Freehill travel the world staging theatrical productions for the Army. And they have seen a difference since the end of ‘don’t ask, don’t tell’

The end of “don’t ask, don’t tell” was a long time in coming — not only for the estimated 65,000 gays and lesbians serving in the U.S. Armed Services, but also for others engaged in little-known, supportive roles for active-duty personnel.

Dallas show business couple Darryl Allara and Ken Freehill, who tour the globe as civilian contractors for U.S. Army Entertainment, were as relieved as anyone else last fall when President Barack Obama officially recognized the end of the 18-year-old discriminatory policy. The life partners quietly cheered the Department of Defense memo released Sept. 20 lifting the ban on homosexuality, knowing it would provide a new sense of freedom for both them and the gay and lesbian soldiers they encounter on military installations.

“I think that in the communities we’ve been in, things are less tense,” said Freehill during an interview at their East Dallas home recently while the couple took a holiday break from 202 days on the road in 2011.

“I think maybe those people in the past who may have felt reluctant to talk to us now feel more comfortable in approaching us,” he added.

At the military installations Allara and Freehill visit, there are ample opportunities for one-on-one conversations with soldiers. Both men are judges for the U.S. Army’s Festival of Arts, and in a separate contractual project they stage Murder 101, an interactive comedy tailored to each base using soldiers and their family members and base civilian employees as actors.

“When we walk into a room, there is so much enthusiasm from everyone,” said Freehill, who has 30 years of experience as a director, producer, writer and actor and currently performs in one-man plays locally.

In staging the murder mystery dinner theater productions, the couple meets with volunteers who are interested in performing, assigns them roles, conducts rehearsals, markets the production, directs the shows and appears in the performances — all in one week’s time. It’s a  challenging task with a taxing schedule that they’ve mastered and carried out for 10 years now.

“We’ve been very mission-oriented, bringing theater to where it doesn’t exist,” said Allara, who received a U.S. Army scholarship that led to a degree in theatrical producing and directing after he ended a tour as a medic in Vietnam in 1969.

“By the time the week is over it looks like we’ve been working with them for a month,” Allara said.

Before the ban was lifted, it was a complex situation for Allara and Freehill, who in their roles entertaining, training and evaluating soldiers and their families weren’t subject to the provisions of the military prohibition on being openly gay. They wanted to be honest about themselves, yet not detract from the mission of their work.

“I did feel the policy had to be respected, because we never wanted to put a soldier in an awkward position, and we never wanted to cause anyone to be uncomfortable,” Allara said. “Our whole mission is to bring joy to everyone.”

Even so, the couple knew people would figure out they weren’t the rank-and-file type of civilian workers that soldiers expect to see on military bases, Allara noted.

“We have never encountered overt discrimination,” Allara said. “By the same token, we have never hidden who we are. It’s not a subject we initiate, but we’ve had soldiers talk to us about it.”

Freehill said that during 2011 while the Pentagon implemented the repeal of DADT and conducted related training for military personnel the couple traveled to 37 military installations for 50 events on three continents. They completed their work without experiencing any of the types of discriminatory incidents many naysayers warned would happen in the military if Congress lifted the ban, he said.

“People figure out in short order we’re a couple, and not just a theatrical partnership,” said Freehill, who points out they have been a couple for 32 years. “They see us together. We don’t make a big deal out of it. But they aren’t dumb.”

Freehill said they have always been careful not to give anyone the wrong impression.

“We are not on the make, and we don’t give that vibe off,” Freehill said. “Everyone feels secure. We are never alone with anyone.”

Allara said his experiences with the military have, for the most part, always been positive and no more discriminatory than in any other walk of life.

As a helicopter medic in Vietnam, he got his first taste of show business when he produced theatrical shows for fellow soldiers using what he had learned at a base playhouse during basic training at Fort Sam Houston in San Antonio.

“For lack of a better word it was a M*A*S*H unit, and I was my unit’s Radar O’Reilly,” said Allara, who noted he “screamed all the way” when he was forced to abandon his company clerk duties and fly in the helicopters to combat zones.

Allara said that deplorable conditions in Vietnam inspired him to take on the staging of a show and probably encouraged fellow soldiers to welcome it.

For one show he requisitioned six jeeps and drivers for the use of their headlights in a theatrical production. A stage was fashioned out of an old flatbed truck.

“We had a terrible morale problem,” Allara said. “We were looking for diversion. We needed to find a way to bond everyone together.”

Rather than getting court-martialed for the jeep stunt as he feared might happen, Allara’s amateur shows, including Sorry Wrong Number, brought him praise and requests for productions at other locations, including a production of Stop the World; I Want to Get Off.

Those efforts eventually led to his Army-sponsored scholarship to theatrical school in San Diego.

Allara said it is ironic that his theatrical work in the Army led to his lifelong career because he had no interest in theater in high school. The U.S. military has sponsored entertainment programs for personnel since World War II, and most bases had theatrical playhouses before television viewing became the most popular form of entertainment.

“When I was drafted I had no thoughts about theater at all,” Allara said. “I was picked on as a kid, and standing in front of people performing was the last thing I wanted to do.”

Later, Allara attended graduate school at the University of Arizona where Freehill was an undergraduate, but they never met. Oddly, they discovered later they had participated on a theatrical production at the same time, and they have a playbill with both of their names listed to verify it.

The couple later met in Los Angeles on a theatrical production and became lovers. For a while they operated a show business school together before relocating to Dallas, where Freehill took a job as executive director for the Screen Actors Guild.

It was about that time 17 years ago when Allara resumed his association with the military, accepting a job as a traveling second judge for the Army Festival of the Arts, a 40-year-old organization. The senior judge for the organization with whom Allara worked on a Bicentennial show in 1976 sought him out for the position.

“You meet people in life,” Allara said. “They go out of your life and then they come back.”

When about five years later the senior judge retired, Allara knew he didn’t have to look far for a new second judge. The Screen Actors Guild had relocated from Dallas to another city, leaving Freehill without a job.

So he joined the Army, too, so to speak.

About 10 years ago Allara and Freehill began staging their murder mystery productions for the Army. They first had designed and produced the mystery shows in Los Angeles, and they tried them out on military audiences with success.

An early production took place in Fort Campbell, Ky., where they still command great respect from base officials, volunteers and audiences, according to Linda Howle, director of the base recreation center.

“They are amazing, and they are fantastic,” said Howle in a telephone interview. “They are very creative. Every time I have them here they do a wonderful job, and when they come back it is always an even better performance.”

Allara said one of the reasons that he and Freehill enjoy so much respect from military officials is that they have a reputation for making sure the show will go on, no matter what. Their sexual orientation seems to have mattered little, if any at all, to Army officials in charge of military entertainment.

“They know they have two theater specialists they can send anywhere in the world,” Allara said.

About 15 years ago, Allara said, he met with a commanding officer who wanted to hire him, and he told the official about his relationship with Freehill.

“I knew they were rounding up soldiers and prosecuting them,” Allara said. “I told him I didn’t want it to bite him in the ass later. He thanked me for telling him.”

Allara said one of the reasons he and Freehill work together well as a romantic and a professional couple is that it is also economically advantageous to them. The Army pays them a flat fee for their work, from which all expenses must be deducted, and the arrangement of staying together on trips allows them to save money.

“We are able to keep rates really low for the Army because we share accommodations,” Allara said.

Fees for Allara’s and Freehill’s contracts come from discretionary funds raised by the Army from ticket sales and other enterprise activity, not from tax dollars, according to the show business couple.

The couple said the only hint of discrimination they ever felt during their travels for the military was when hotel staff asked if they wouldn’t prefer separate beds or rooms. Although they’ve never lost a military contract because of their sexual orientation, they did lose a couple in Los Angeles years ago because of it, they said.

“Discrimination is everywhere,” Allara said.  “It doesn’t have to be in the military.”

Allara said that as a combat veteran he sees the greatest benefit of the new policy to gay and lesbian soldiers to be the security of being part or a team, not the advantage of freedom of expression and social acceptance.

“They now will be able to serve their country without worrying about their backs in addition to the enemy in front of them,” Allara said.

For Allara and Freehill, life will continue much as it has for the past decade, together night and day except for when they are out of town on separate judging assignments. It seems natural to wonder whether they might enjoy the occasional break from each other’s company, but that is apparently not the case.

“It’s lonely,” Freehill said. “I admit it. We usually can’t wait to get home to be in each other’s company.”

Allara said that they often debate many subjects related to their work, but they always agree on how they feel about returning home to the company of the best audience anyone could have — the three dogs they rescued.

“It’s like dying and going to heaven for us,” Allara said.

WATCH: Friends say Florida A&M band member beaten to death in hazing ritual was gay

Friends of Robert Champion, the Florida A&M University drum major who died after being beaten in a hazing ritual in November, have told his family’s attorneys that Champion was gay.

CNN reports that Champion’s relatives now believe his sexual orientation may have been one of many factors that contributed to Champion being treated more severely than other band members.

The Associated Press reports today that Champion’s family plans to sue the company that owns the bus where the hazing took place, in addition to the university.

Equality Texas slams Perry

As we noted below, it sounds as though Rick Perry is staying in the Republican presidential race, at least until the Jan. 21 South Carolina primary. But before Perry could announce his intentions, Equality Texas, the statewide LGBT advocacy group in his home state, issued a statement rejoicing in the governor’s poor showing in Iowa and declaring that Perry “will not be the next president of the United States.” Here’s the full text:

The good news is that Texas Governor Rick Perry will not be the next president of the United States. Governor Perry’s homophobic pandering did not resonate with Iowa voters just as it does not resonate in Texas.

As Governor Perry returns to Texas to reflect on his campaign, it is our hope at Equality Texas that he will also reflect on what Texans really want for their state.

Over 75% of Texas voters support prohibiting employment and housing discrimination based on sexual orientation (1), and over 63% of Texas voters support legal recognition for same-gender couples (2).

It is time our Governor recognize that homophobia and transphobia have no place in our great state and he should join in the effort to eradicate them from all public policy.

Top 10: Suicides led to anti-bullying law

In the fall of 2010, a number of high-profile suicides brought attention to the problem of bullying in schools. This year, the LGBT community worked to change laws and save lives.

After helping to push through policies in the Dallas and Fort Worth school districts, as well as a few others around the state, the LGBT community focused on passing statewide anti-bullying legislation in the 2011 session of the Legislature.

Equality Texas made the legislation a priority and a number of bills were introduced.

In February, Equality Texas hosted a Lobby Day. Several hundred people from around the state participated.

Among them were Fort Worth City Councilman Joel Burns, suicide victim Asher Brown’s parents — Amy and David Truong — and a group of 10 students from Youth First Texas.

Burns and the Truongs met with key legislators including members of the committees that would  hear the bills.

The students from YFT spoke to their senators and representatives telling their own stories of being bullied.

Legislators not usually considered allies were visibly moved by stories of violence in schools in their hometowns.

Equality Texas board chair Anne Wynn, Executive Director Dennis Coleman and Deputy Director Chuck Smith spent the spring lobbying on behalf of the bills.

The organization arranged for the Truongs as well as the parents of Montana Lance and Jon Carmichael, two other Texas suicide victims, to testify at committee hearings.

As originally crafted, the bills specified categories that would be covered. National studies have shown that the more specific the law, the more effective it is in protecting LGBT students. When sexual orientation and gender identity are not specified, school staff often ignore anti-gay bullying. But to increase the chances that anti-bullying legislation would pass, several bills were combined and all references to specific groups, including sexual orientation and gender identity, were deleted.

The new anti-bullying “super bill” passed unanimously in the Senate and by a wide margin in the House — and was eventually signed by Republican Gov. Rick Perry.

Under the new law, for the first time, the bully rather than the victim can be transferred to another classroom or school. Parental notification rules were strengthened and protections added for the person reporting the bullying. The definition of bullying now includes electronic means, or cyberbullying. And every school district must adopt an anti-bullying policy, including any necessary procedures to address the prevention, investigation and reporting of incidents.

A second bill also passed that provides money for counseling services, which includes services for both the bully and the victim. School staff already receive training to recognize potential suicide risks. That training will be expanded to include victims of bullying.

Meanwhile, although the Dallas Independent School District approved an LGBT-inclusive anti-bullying policy last year, Resource Center Dallas and Lambda Legal accused some DISD officials of blocking its implementation.

RCD Executive Director and CEO Cece Cox along with Lambda Legal community educator Omar Narvaez addressed the DISD board about the problem in December.

Cox said she had gotten word from frustrated school district employees that principals were being instructed not to use the electronic reporting system that the board mandated. She said she would continue to track the district’s compliance with the policy in 2012.

Top 10: County, DISD, FWISD added trans protections

Although transgender rights continue to be the last frontier in the ongoing battle for LGBT equality, the trans community made significant progress in North Texas in 2011.

The all-too-familiar scenario of transgender being left out of laws protecting lesbians and gays played out in March when the Dallas County Commissioners Court voted in favor of adding sexual orientation — but not gender identity and  expression — to the nondiscrimination policy covering the county’s roughly 7,000 employees.

County Judge Clay Jenkins and Commissioner Dr. Elba Garcia, two Democrats who spearheaded the addition of sexual orientation to the policy, said they had not been aware of the distinction between sexual orientation and gender identity and expression.

But after Dallas Voice reported on the oversight, LGBT advocates went back to the court to insist that commissioners correct the omission.

Republican Commissioner Maureen Dickey added insult to injury during an April Commissioners Court meeting when she not only announced she would vote against trans protections, but also compared being transgender to being overweight.

But on April 26 — after activists spoke at several consecutive meetings in an effort coordinated by Resource Center Dallas — the court voted 3-2 along party lines to add trans protections. Jenkins, Garcia and Commissioner John Wiley Price voted in favor of trans protections, while Dickey and fellow Republican Mike Cantrell voted against them.

Dallas County is the only county in the state with a trans-inclusive employment nondiscrimination policy — and momentum from the decision appeared to spread as the year went forward.

In late June, the Fort Worth school board added gender identity and expression to the district’s anti-bullying policy. And in early August, shortly before the start of a new school year, came news that the Dallas school board would consider a series of policy changes intended to protect transgender students, faculty and other employees from discrimination and harassment. The vote to add the protections came on Aug. 25.

The wave of transgender victories hit a small snag in November, when the Dallas County Community College District initially refused to add trans protections, insisting that the district’s protections based on sexual orientation covered trans people. But after another effort coordinated by the Resource Center, DCCCD President Wright Lassiter announced in November that an amendment to the district’s nondiscrimination policy to specifically protect transgender people is on the agenda for the board’s January meeting.

Top 10: Reno attack made national news

Burke Burnett says he was inspired to come out as gay at 15 after learning about the hate crime murder of gay Wyoming college student Matthew Shepard. Thirteen years after Shepard’s death, Burnett himself became the victim of a brutal anti-gay hate crime in Reno, Texas, a small town east of Paris and 100 miles northeast of Dallas.

Burnett, now 26, was at a Halloween party in the early morning hours of Oct. 30 when he was jumped by three men who yelled anti-gay epithets as they stabbed him repeatedly with a broken beer bottle, before throwing him onto a lit burn barrel.

Burnett said he’d never before had problems in his hometown due to his sexual orientation, but he believes the men were trying to kill him.

It took 30 stitches to close stab wounds to his back and forearm, as well as a cut above his left eye. He also sustained second-degree burns and severe bruises.

It was arguably the worst anti-gay hate crime Texas has seen since Jimmy Lee Dean was beaten nearly to death in the heart of Dallas’ gay entertainment district in 2008. And for many in East Texas, Burnett’s beating undoubtedly evoked memories of the 1993 murder of Nicholas West in Tyler.

Fearing that local authorities wouldn’t treat the crime seriously, Burnett’s friends contacted the media. After graphic photos of his injuries were posted on DallasVoice.com, the incident quickly made national news.

Reno police were tightlipped about their investigation, but within days they’d arrested three men in connection with the crime — 31-year-old James Mitchell Lasater III of Paris, 25-year-old Micky Joe Smith of Brookston and 33-year-old Daniel Shawn Martin of Paris.

The suspects each were charged with multiple counts of aggravated assault, but under Texas law, it would be up to prosecutors to decide whether to treat the case as a hate crime.

And LGBT advocates weren’t terribly optimistic, given that in the 10 years since Texas’ statute was passed, only about a dozen cases have been prosecuted as hate crimes.

They would be pleasantly surprised, however, when on Nov. 10 the Lamar County District Attorney’s Office announced that that all three suspects would face hate crimes enhancements.

Aggravated assault is a second-degree felony punishable by up to 20 years in prison, but the enhancements would bump up the charges, making them first-degree felonies punishable by life in prison.

WATCH: Rick Perry tells 14-year-old girl she’s a sinner, says “openly gays” shouldn’t be serving

Texas Gov. Rick Perry was confronted at a town hall in Iowa on Sunday about his opposition to gays serving openly in the military, a stance which he highlighted in a recent TV ad.

ABC News reports that 14-year-old Rebecka Green, an openly bisexual high school student, confronted Perry during a town hall in Decorah.

“I just want to know why you’re so opposed to gays serving openly in the military, why you want to deny them that freedom when they’re fighting and dying for your right to run for president,” Rebecka said.

Perry, who was apparently unaware of Rebecka’s sexual orientation at the time, responded as follows (note that “openly gays” is NOT a typo):

“Here’s my issue: This is about my faith, and I happen to think that, you know, there are a whole hosts of sins, homosexuality being one of them, and I’m a sinner and so I’m not going to be the first one to throw a stone. But to openly — it’s just like the Boy Scouts, do you recall when the Boy Scouts were sued to let openly gay individuals serve as Scout master? And that again is one of those issues that I don’t agree with. And I don’t agree that openly gays should be serving in the military. ‘Don’t Ask, Don’t Tell’ was working and my position is just like I told a guy yesterday. He said, ‘How would you feel if one of your children was gay?’ I said I’d feel the same way. I hate the sin, but I love the sinner, but having them openly serve in the military, I happen to think as a commander in chief of some 20,000 plus people in the military is not good public policy, and this president was forced by his base to change that policy and I don’t think it was good policy, and I don’t think people in the military thought it was good policy.”

With adults telling 14-year-olds that they’re sinners, is it any surprise that LGBT youth are taking their lives at such alarming rates? Thankfully, it sounds like Rebecka has a very supportive father in Todd Green, a Democrat and professor of religion at Luther College, who offered this takedown of Perry’s position, according to ABC:

“My daughter Rebecka particularly was very incensed by the ad Governor Perry ran a week or two ago here in Iowa where he complained about the problem of gays serving openly in the military but Christians not being able to celebrate Christmas openly. He seemed to get that backwards,” Todd Green said.

“It takes no courage to come out of the closet to be a Christian and run for president of the United States,” he said. “I’d be more impressed if you were Muslim or an atheist and coming out like that, but to come out as though this was an act of courage for him to proclaim his Christian faith, but he also wants to take the stand against gays in the military. This is someone who’s in the position of power and privilege and he’s abusing it.”

Titled “Strong,” Perry’s ad created a firestorm upon its release two weeks ago, even causing tension within his own campaign after reports emerged that a top aide strongly objected to the ad.

Asked what he thought of the governor’s explanation that he “hates the sin” but “loves the sinner,” Todd Green said, “I have always hated that phrase. I think it’s impossible and you show it by action. If you love the sinner, whatever that means, your policy should reflect that I think, but in the end, I don’t understand the logic behind that at all.”

Exxon Mobil hits new LGBT low

Company is 1st with negative score on HRC’s Corporate Equality Index

IRVING — Exxon Mobil Corp. has again made history for its anti-gay employment practices.

The Irving-based company, which is No. 2 on the Fortune 500 and has more than 80,000 employees worldwide, last week became the first business to ever receive a negative score on the Human Rights Campaign’s annual Corporate Equality Index.

The 2012 edition of the Index, which marks the 10th anniversary of HRC’s scorecard, includes ratings for 636 major companies based on their LGBT-related employment practices.

Exxon Mobil failed to meet any of the criteria for the 2012 Index, and had points deducted for engaging in activities that undermine LGBT equality. As a result, the company received a score of minus-25 from HRC.

Before Exxon and Mobil merged in 1999, Mobil offered domestic partnership benefits and had an employment nondiscrimination policy that included sexual orientation. However, ExxonMobil did away with both the benefits and the policy after the merger, and has repeatedly resisted shareholder efforts to amend the policy to protect gay employees.

The 2012 Index marks the first year HRC has handed out negative scores, and Exxon Mobil was the only company to receive one.

“For over a decade, HRC has urged Exxon Mobil to re-evaluate its employment practices and policies regarding LGBT employees,” HRC spokesman Paul Guequierre said. “They continue to give us, and the entire LGBT community, the cold shoulder.”

William F. Holbrook, a spokesman for ExxonMobil, sent Dallas Voice a copy of the company’s “Corporate Citizenship Report,” which says it has a “zero-tolerance” policy against “discrimination based on sexual orientation and gender identity.”

However, Guequierre said the Corporate Citizenship Report isn’t an Equal Employment Opportunity statement, and lacks the legal force an EEO statement carries.

Exxon Mobil’s report also says the company offers health benefits to the partners of gay employees in countries where same-sex marriage is legal, but goes by federal law in the U.S., which only recognizes heterosexual spouses.

Holbrook declined to further discuss the company’s negative score on the CEI.

Exxon Mobil was one of three companies to receive the 25-point deduction for undermining LGBT equality on the 2012 Index. The other two were New York-based Verizon Communications Inc. and Milwaukee-based Foley & Lardner LLP.

Deena Fidas, director of HRC’s Workplace Project, said Verizon was penalized for resisting a shareholder resolution to add gender identity to the company’s employment nondiscrimination policy; while Foley & Lardner was docked for representing the National Organization for Marriage in campaigns against marriage equality in the District of Columbia and Minnesota.

Verizon received an overall score of 20, while Foley & Lardner got a 60.

“It is not a designation that we take lightly,” Fidas said of the 25-point deduction for undermining LGBT equality. “These businesses did nothing to rectify these particular situations.”

On a more positive note, Fort Worth-based AMR Corp. (American Airlines) is one of only nine companies that have received perfect scores every year since the Index began in 2002, Fidas said. The others are Aetna Inc., Alcatel-Lucent, Apple Inc., Eastman Kodak Co., JPMorgan Chase & Co., Nike Inc., Replacements Ltd. and Xerox Corp.

Those nine employers all managed to maintain their scores of 100 on the 2012 CEI despite new, more stringent criteria — most notably a requirement to offer comprehensive transgender health benefits, including coverage for gender reassignment surgery.

Lauri Curtis, vice president for diversity at American Airlines, said adding comprehensive trans health benefits was “the right thing to do for our business.”

“We don’t look at it as how difficult it was,” Curtis said. “The bottom line is that we have a very diverse population, both our employees as well as our customers, and that’s really what we true ourselves to. That’s our driving guidepost as it relates to our diversity efforts.

“At the end of the day it’s all about equality and respect for everyone,” she added. “I think it just underscores that this is serious stuff to us, because it’s just part of who we are. It’s been part of who we are for a long time.”

American Airlines and AT&T Inc. were the only North Texas-based companies that satisfied all of the new criteria and received perfect scores on the 2012 CEI. That’s down from nine local companies that received HRC’s top rating on the 2011 index.

Nationally, 190 companies received perfect scores this year, down from 337 last year. But Fidas said comparing this year’s scores to last year’s amounts to apples and oranges. In addition to trans health coverage, HRC added criteria in 2012 related to “soft” partner benefits, organizational competency on LGBT issues, and public support for equality.

“It’s a new standard,” Fidas said. “We raised the bar in these four significant areas, and some businesses are just going to take a little more time to get there. We don’t see that as a drop or a lack of commitment.”

In fact, Fidas said, this year’s Index shows remarkable progress as employers strive to meet the new criteria. For example, two years ago, only 49 employers offered comprehensive trans health benefits, but since then the number has jumped to 207.

Representatives from North Texas-based companies that lost their perfect scores on this year’s CEI said they’re disappointed but committed to working toward re-establishing them.

“Anytime that you were on a list and then you’re not a on a list, it does cause some angst,” said Steve Lyle, chief diversity officer for Dallas-based Texas Instruments, which received a 90 on the 2012 Index after four consecutive years of perfect scores. “We don’t want that segment or our employee population to feel disenfranchised because TI’s no longer on this list, or feel like we care less today than we did last week.”

That’s why the company sent emails to LGBT employees in advance of the Index’s release explaining the reason for the lower score: The company’s insurance provider, Blue Cross Blue Shield, doesn’t consider gender reassignment surgery to be a medically necessary procedure.

Texas Instruments could have overridden Blue Cross’ decision at a minimal cost, Lyle said. However, that would have been unfair to employees who want coverage for other procedures that aren’t considered medically necessary, including growth hormones for children and in vitro fertilization.

Lyle added that TI is interested in working with HRC and other employers to convince insurance providers that gender reassignment surgery — historically regarded as cosmetic — should instead be deemed medically necessary.

“We’re in the business of making electronics, not in determining medical necessity, but we do want to influence the conversation, because it aligns with our values,” said Lyle, who’s openly gay. “We want to be able to offer benefits to our employees that are necessary for them, but we also want to have internal equity of those benefits.”

Plano-based J.C. Penney Company Inc. also lost points for failing to offer comprehensive trans health benefits, and saw its score drop from a 100 to an 85.  Daphne Avila, a spokesman for J.C. Penney, said in an email this week that the company will “continue to explore cost-effective options for improving associate benefits.”

“Given our record of achieving a perfect score three out of the past four years, our current ranking is not where we would like it to be,” Avila wrote. “While the new guidelines present opportunities for advancement across all industries, our score – albeit not poor – does not accurately reflect our overall commitment to inclusion and diversity. … While we are unable to guarantee our future standings, please know that we are already evaluating the 2013 HRC criteria and are looking for opportunities to raise the bar.”

Representatives from Grapevine-based GameStop, which saw its score drop from 100 last year to 75 this year; and Dallas-based Brinker International, which saw its score drop from 100 to 60, didn’t respond to requests for comment this week.
